TACLOBAN CITY - The Office of the Ombudsman has suspended Borongan City Mayor Jose Ivan Dayan Agda for 90 days from Nov. 25, 2025 to Feb. 25, 2026.
He was suspended for a complaint in 2019 finding him guilty of violating Republic Act 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees).
However, he was cleared of graft and corruption and abuse of authority.
Agda was suspended July but opted to serve the order from November to February.
“I accept the decision with a clear conscience. This shows our respect for the law and I want to serve a good example to my fellowmen. As I’ve said, there is a greater purpose for this setback," Agda said.
Section 46(a) of Republic Act No. 7160, also known as the Local Government Code of 1991, says when local chief executives are temporarily incapacitated, the duly elected vice mayor shall assume the duties and responsibilities of the office of the city mayor during the suspension.
Vice Mayor Emmanuel Tiu Sonco has been ordered by the Department of Interior and Local Government Provincial Director Johannes Dorado to assume the mayor’s position.
“This assumption is made in the interest of continuity of public service and in faithful compliance with the mandates of law," Dorado said.
Sonco will carry out the functions and responsibilities of the Office of the Mayor until Feb. 25.
