ICI recommends filing of criminal charges vs DPWH officials, contractor in Bulacan's P74-M 'ghost' flood control project
The Independent Commission for Infrastructure (ICI) submitted to the Office of the Ombudsman (OMB) on Thursday, Nov 13, its interim report on the P74 million ghost flood control project in Hagonoy, Bulacan.
It told the OMB its report was based on the data submitted by the Commission on Audit (COA) which found that there was no flood control structure in the location indicated in the approved bid plans.
It recommended the filing of criminal charges against the officials of the Department of Public Works and Highways (DPWH)-Bulacan 1st District Engineering Office and private contractor Darcy & Anna Builders and Trading.
The ICI said that during the COA's technical inspection, it was established that the project in Barangay Carillo in Hagonoy town was never implemented.
However, it also said, the DPWH still released the full payment of the contract cost to Darcy & Anna Builders and Trading.
The ICI said that several DPWH officials were grossly negligent, if not remiss, in their official functions.
They were identified as Engineer Henry Alcantara, Engineer Brice Ericson Hernandez, Engineer Ernesto Galang, Engineer Jolo Mari V. Tayao, Engineer John Michael Ramos, and Engineer Lemuel Ephraim Roque. Darcy Kimel D. Respecio of Dary & Anna Builders was also found liable over the ghost project, the ICI said.
The ICI recommended that violations of the Anti-Graft and Corrupt Practices Act and the Government Procurement Reform Act, and malversation of public funds, falsification of public documents, and falsification be filed against the respondents.
"The participation of the aforementioned public officials in the anomalies and irregularities relating to the project appears to have been indispensable in achieving their objective, together with the concerned private individuals, to defraud the government," the report stated.
The ICI also recommended that former DPWH secretary Manuel Bonoan, and undersecretaries Roberto Bernardo and Maria Catalina Cabral be investigated for violations of the Code of Conduct and Ethical Standards for Public Officials and Employees.
"The deliberate failure of the concerned public officials to fulfill their duties clearly warrants the filing of appropriate administrative charges," the report said.
The latest interim report was the fifth report submitted by the ICI to the OMB for the conduct of preliminary investigations that may lead to the filing of criminal charges before the Sandiganbayan or the regional trial court (RTC).
