SM Entertainment says EXO's Chen, Baekhyun, Xiumin should pay, restore trust
SM Entertainment belied the statement of EXO members Chen, Baekhyun and Xiumin, who also belong to the EXO-CBX subunit, that they have accepted the terms set by the company stemming from their legal disputes.
On Oct. 27, SM Entertainment announced that Suho, Chanyeol, D.O., Kai, Sehun and Lay Zhang will be participating in the EXO'verse Fanmeeting in December and in the new album that will be released next year.
Chen, Baekhyun and Xiumin were excluded from the comeback plans. SM Entertainment and the three K-pop stars are currently embroiled in a court case about their contract and issue of payment.
On Oct. 29, INB100, EXO-CBX’s agency for their individual activities, issued a statement, saying that the three want to participate in EXO’s comeback plans.
“After the second mediation date (October 2), EXO-CBX clearly communicated their intention to reach an agreement, accepting all of SM's conditions for a full EXO comeback at the end of the year,” INB100 stated.
Following the announcement, SM Entertainment issued its own statement to refute it.
In its announcement, SM Entertainment referred to the three by their real names instead of their stage names.
“We would like to address the statement from Byun Baekhyun, Kim Jongdae, and Kim Minseok,” SM Entertainment said.
It added, “We have clearly stated to the three that the agreement to end the dispute and team activities are separate matters.”
“First, regarding the settlement of the dispute, we have won all disputes to date. Our only request to the three was payment of 10 percent of their individual activity revenue as stipulated in the existing agreement dated June 18, 2023. However, this has not yet been fulfilled,” the agency said.
Under the agreement, Chen, Baekhyun and Xiumin need to pay 10 percent to SM Entertainment from their income from individual activities.
“Furthermore, regarding the issue of participating in group activities, the numerous disputes have not only significantly damaged trust between the two parties, but has also caused significant harm to EXO as a team, fans, and the members. Therefore, it was only natural that the three should first fulfill the existing agreement and make sincere efforts to restore trust,” SM Entertainment stated.
But it said that on the contrary, the three singers filed an objection after the second mediation about the court case failed.
“However, contrary to their statement that they had clearly communicated their intention to reach an agreement and accepted all of the terms proposed by the company after the second mediation date on October 2, the three first filed an objection on October 16. We cannot help but express deep regret at the three sides' announcement today, which distorts the facts about the circumstances,” SM Entertainment said.
SM Entertainment added, “We will do our utmost to support EXO's activities, which will begin in December.”
