Sen Chiz Escudero asks SC to disbar lawyer for 'accusatory, defamatory, demeaning, hateful' remarks
Senator Francis “Chiz” G. Escudero asked the Supreme Court (SC) to disbar lawyer Jesus Nicardo Madarang Falcis III for violation of the Code of Professional Responsibility and Accountability (CPRA).
In a verified complaint filed on Monday, Sept. 29, Escudero told the SC that Falcis maintains a “verified’ Facebook profile under the name “Jesus Falcis.”
He said that that Falcis “made several Facebook public posts in his Facebook profile containing accusatory, defamatory, demeaning, speculative, hateful and/or malicious statements and remarks against complainant (Escudero), all unbecoming of a member of the Philippine Bar and quite unfortunately, against a fellow member of the Philippine Bar.”
He also said the “unwarranted and professionally irresponsible statements and remarks” were made by Falcis on the occasion of or in connection with the issue on the government flood control programs, including the 2025 national budget deliberations.
Falcis could not be contacted for comment as of posting time.
In his complaint, Escudero said that Falcis made multiple posts from July to September2025. He also said that among Falcis’ remarks were calling him “shameless,” “the worst Senate President in history,” and repeatedly referring to him as “bulok na keso” or “rotten cheese.”
“Unfortunately, such statements and remarks are actually gratuitous instruments of contempt designed to publicly humiliate me. As such, the irresponsible and unrestrained character serve to provide a bad and scandalous example of how a lawyer should not behave publicly,” also told the SC.
Escudero pointed out that the “ill-tempered and hateful language of Falcis in social media “betray not only the lack of restraint and virtue expected of a lawyer, but also an inexplicable contempt for the complainant.”
He also said that Falcis disregarded the nature, reach and power of social media in the latter’s posts which can be picked up by other media and can translate into other iterations.
Thus, he added that “clearly at stake is not only the complainant’s good name and reputation, but also the integrity and honor of the legal profession.”
At the same time, Escudero told the SC: “Falcis failed to abide by the highest standards of the legal profession as to warrant the extreme penalty of disbarment. And while it may be argued by respondent (Falcis) that he employed ‘only words’ as to perhaps justify a lighter penalty, the public and tenacious character of his conduct require no less than removal from the Roll of Attorneys.”
He pointed out that public officials must accept criticism, and lawyers, on the other hand, are duty-bound to exercise their rights with dignity.
He stressed that as a duly elected public official who has been in public service for many years, he respects the right of every citizen, including the respondent as co-member of the Philippine Bar, to comment on matters of public interest.
“Frustratingly enough, the respondent crossed the line. And even granting without admitting that he may have had a point with regard to these postings, still the nobility of the profession requires him to speak and comment in a dignified and non-insulting manner and with due respect to a member of the Philippine Bar,” he added.
Escudero asked the SC: “Accordingly, premises considered, complainant Francis Joseph ‘Chiz’ G. Escudero most respectfully prays that the Honorable High Court disbar respondent Atty. Jesus Nicardo M. Falcis III and directed the Office of the Bar Confidant to have the name Jesus Nicardo M. Falcis III stricken off from the Roll of Attorneys.”
