Marcoleta asks DOJ to issue lookout order vs DPWH execs, contractors

Senator Rodante Marcoleta has asked the Department of Justice (DOJ) to place several officials of the Department of Public Works and Highways (DPWH) and contractors involved in the anomalous flood control projects on the Immigration Lookout Bulletin Order (ILBO).

In separate letters dated Aug. 27 and 28, Marcoleta, who chairs the Senate Blue Ribbon Committee, asked that they be informed whether such persons are about to leave or abscond from the Philippines or whenever arrive in the country.
The DPWH officials listed are Usec. Maria Catalina Cabral, Ramon Arriola III, Luz Dela Rosa, Gerard Opulencia, Roseller Tolentino, Jayson Jauco, and Norberto Santos.
Also included are Henry Alcantara and Brice Ericson Hernandez.
Alcantara was the former district engineer at the center of "ghost" flood control projects issue in Bulacan.

Also, the Blue Ribbon panel requires Edgar S. Acosta, President, Hi-Tone Construction and Development Corp. to show cause why he should not be cited in contempt.
Meanwhile, Marcoleta revealed that some individuals linked to alleged irregularities in flood control projects are currently abroad.
“Hindi naman ibig sabihin lumabas dahil doon…may nagsasabing nasa ibang bansa (It doesn’t necessarily mean they left because of that [hearing]…there are just reports saying they’re in another country),” Marcoleta said, clarifying that he was not accusing them of hiding or fleeing but confirming that information has surfaced indicating their absence from the country.
Marcoleta noted that while some contractors have representatives attending the hearings, their capacity to answer crucial questions remains in doubt.
“May representative sila, ang problema lang may capacity ba para irepresent sila lalo na sa mga tanong na very crucial…maaari namin silang ipaaresto eventually, dalawa na lang naman ata ‘yun (They have representatives, but the problem is whether they have the capacity to represent them, especially when it comes to very crucial questions… we may eventually have them arrested; I think there are only two of them left),” he said.
The lawmaker explained that proper procedures would be followed, including issuing a show cause order and subpoenas, before considering warrants of arrest.
He added that these contractors are reportedly among the “top 15” who received the lion's share or 20 percent worth P100 billion of the country's flood control budget for the past three years
Marcoleta said he hopes all parties will be represented in the hearings, suggesting that the hearing be scheduled outside regular session days to allow more time for discussions.
“Sana andun na lahat, sana represented na lahat…ang iniisip ko nga di na session day para buong araw para mas maraming matake up (I hope everyone will be there, I hope everyone will be represented… what I’m thinking is to hold it on a non-session day so we can use the whole day and cover more matters),” he remarked, adding that the next hearing may be scheduled on Thursday or Friday after the hearing on Monday.
The senator also disclosed that certain individuals have expressed willingness to testify, but he emphasized that their statements must provide substantial information.
“May mga feelers kaya lang ang aking sinasabi gusto ko muna makita extent ng kanilang sasabihin. Kung wala namang bago, paano naman ‘yun. Pinakamaganda madetermine natin ano ba sasabihin mo, meron ka bang ituturo, magtatapat ka ba, tapos saka natin titimbangin (There are some feelers, but what I’m saying is I want to first see the extent of what they will say. If there’s nothing new, then what’s the point? It’s best that we determine—what exactly will you say, will you point to someone, will you come clean—and then we will weigh it from there),” Marcoleta said.
Senate President Pro Tempore Jinggoy Ejercito Estrada, said that "flight" means admission of guilt.
On the other hand, he's also contemplating on the idea of citing Discaya in contempt.
"She's a blatant liar. Her statement is full of inconsistencies," he added.
