DAVAO CITY – Former President Rodrigo Duterte’s defense team has filed its plan for the upcoming International Criminal Court hearing on the confirmation of charges against him and renewed their appeal for his interim release from detention.
In a filing submitted to Pre-Trial Chamber I dated Aug. 22, 2025, lead counsel Nicholas Kaufman outlined that the defense will allocate 30 minutes for an opening statement, three to four hours for its main arguments, and 30 minutes for a closing statement.
According to the document, the presentation will focus on legal issues surrounding Duterte’s alleged responsibility and whether the requirements for crimes against humanity under the Rome Statute are met.
“For the sake of clarity and the historical record, Mr. Duterte did not commit any criminal offense,” Kaufman said, stressing that Duterte had faithfully served the Philippines “with pride, for many years.”
The confirmation of charges hearing will determine whether the case against Duterte will proceed to trial.
Duterte’s lawyers submitted a heavily redacted “Renewed Request for Interim Release” dated Aug. 18, 2025.
The defense argued that their client does not risk absconding, influencing witnesses, or committing further crimes — conditions outlined under Article 58 (1)(b) of the Rome Statute as justification for continued detention.
“The specific characteristics of Mr. Duterte’s (REDACTED) suggest that none of the risks envisaged in Article 58 can be actualized,” Kaufman wrote, citing assessments from undisclosed experts.
The filing further noted that a cooperating State has expressed readiness to accept Duterte under release conditions, including videoconferencing and monitoring safeguards.
“The Defence reiterates its request that the Pre-Trial Chamber order Mr. Duterte’s immediate release into (REDACTED), subject to any conditions deemed appropriate,” the filing added.
Earlier, the ICC Pre-Trial Chamber allowed Duterte’s team to defer its appeal for interim release, acknowledging administrative hurdles in gathering necessary information for the filing.
The chamber, composed of Presiding Judge Iulia Antoanella Motoc, Judge Reine Adélaïde Sophie Alapini-Gansou, and Judge María del Socorro Flores Liera, is expected to deliberate on the confirmation of charges and the renewed release request in the coming weeks.
