CEBU CITY – Bohol Gov. Aris Aumentado expressed confidence that he can clear his name following the recent decision by the Office of the Ombudsman recommending the filing of criminal charges against him and several others for the construction of a resort in the province’s famous Chocolate Hills.
“Hingpit ako sa akong baroganan nga wala ako nakalapas sa bisan unsang balaod sa ani nga kaso (I am firm in my stand that I never violated any law involving this case),” Aumentado said in a statement released on Friday, Aug. 15.
In a decision released this week, the Ombudsman ordered the filing of criminal charges against Aumentado and former Governors Arthur Yap and Edgar Chatto for alleged violations of Sections 3(e) and 3(i) of Republic Act 3019 or the Anti-Graft and Practices Act.
The Ombudsman reprimanded Aumentado and members of the 20180-2022 Executive Committee of the Chocolate Hills Natural Monument–Protected Area Management Board (CHNM–PAMB) for failing in their oversight duties.
Aumentado will appeal the Ombudsman’s decision.
“We are preparing our answer to the resolution and we will file a motion for reconsideration before the Office of the Ombudsman,” he said.
In its investigation, the Ombudsman said the Captain’s Peak Resort in Sagbayan operated between 2020 and 2024 even without essential clearances such as an Environmental Compliance Certificate (ECC), Environmental Impact Assessment (EIA), and Special Use Agreement in Protected Areas (SAPA).
Despite the absence of the required clearances, the resort was still able to secure business permits and building clearances from local authorities that contributed to the “unrestricted developments” and defaced portions of the Chocolate Hills, a UNESCO-recognized national monument and protected site under the NIPAS and Expanded NIPAS Acts, the anti-graft court said.
To prove that he had nothing to do with the illegal construction, Aumentado said he took swift action when the controversy erupted last year.
“If we can remember, when this issue in Captain’s Peak surfaced last year, I immediately ordered the conduct of an investigation,” the governor said.
Aumentado is hopeful that the Ombudsman will reconsider its ruling.
“We are hopeful that the Ombudsman will review the resolution. I am also hopeful that me and the others involved will be cleared from any violation,” Aumentado said.
