New ERC chief vows to end decade-long rate reset delays

The new chief of the Energy Regulatory Commission (ERC) has vowed to streamline the lengthy rate reset processes and tariff reviews that have burdened distribution utilities for a decade.
In his welcome speech during a leadership turnover on Thursday, Aug. 7, ERC Chairperson Francis Saturnino Juan said his plans include revising the Rules for Setting Transmission Wheeling Rates (RTWR).
“I’m writing the revisions so we could start the reset of private DUs that have yet to finish [their rate reset process] for more than 10 years,” He said. A public consultation is slated to follow.
Juan described this as a “healing process” where the ERC will act as a judge, and applicants will submit their evidence and supporting documents. He aims to complete all outstanding rate resets for distribution utilities within his four-year term.
In addition to speeding up these processes, Juan hopes to attract more investments in the generation, transmission, and distribution sectors by enhancing the regulatory framework.
Former ERC Chairperson Monalisa Dimalanta, on her last day, emphasized that the commission wants the electric cooperative and power supplier for Siquijor Island to honor their original agreement.
Dimalanta clarified that the commission’s action regarding the Province of Siquijor Electric Cooperative (Prosielco) and SI Power Corp. (Sipcor) was not a “rejection” but a recommendation to adhere to their initial deal.
Dimalanta explained, “To clarify, we didn’t reject the deal. They signed a supplemental agreement, but upon evaluation, the commission determined that the supplemental agreement effectively amended the original agreement that was already approved by the commission… There was already a commitment to supply what they wanted to cover in the supplemental agreement.”
She asserted that the supplemental agreement was unnecessary because the original agreement already covered the additional capacity.
Dimalanta also highlighted the ongoing issue of faulty power units in Siquijor, which has led to fluctuating electricity in the area. The Department of Energy (DOE) is currently providing updates on the situation as the units committed under the contract are still not operational.
