VP Sara to respond to House impeachment appeal within required period

The camp of Vice President Sara Duterte said on Tuesday, Aug. 5, that it will comply with the Supreme Court’s (SC) order to comment on the Motion for Reconsideration filed by the House of Representatives seeking to reverse the Court’s ruling on her impeachment case.

“We will comply with the Order of the Supreme Court and submit our Comment within the period provided,” lawyer Michael Poa, one of the 16 members of the Vice President’s defense team, said.

The Vice President’s camp, as well as other petitioners, were given a non-extendible period of 10 days to respond to the motion for reconsideration.

This came after the House of Representatives filed the motion on Monday, Aug. 4, asking the SC to reverse its earlier decision that declared as unconstitutional the impeachment case filed against Duterte.

The Office of the Solicitor General (OSG), which stands as the House’s legal counsel, argued that the approval and transmittal of the fourth impeachment complaint against Duterte back in Feb. 5 was valid because it was signed by 215 members of the lower chamber.

It also stressed that the House did not violate the one-year bar rule based on an earlier Supreme Court ruling that defined initiation as the filing of the complaint and its referral to the proper committee in impeachment proceedings.

The motion asked the SC to allow the impeachment trial in the Senate to proceed as it is the constitutional right of both chambers—the House to initiate impeachment proceedings and the Senate to try.

The Senate was supposed to convene as an impeachment court for Duterte’s trial upon resumption of session, but this was thwarted by the SC ruling. Senators are expected to discuss the impeachment during a session on Wednesday, Aug. 6.

In the verified complaint sent to Senate in February, there were seven Articles of Impeachment against the Vice President.

Among these are betrayal of public trust for an assassination threat against President Marcos, his wife, and the House Speaker, betrayal of public trust and graft and corruption due to the misuse of public funds, and betrayal of public trust and bribery within the Department of Education (DepEd).

She is also facing charges based on the violation of the Constitution and betrayal of public trust due to unexplained wealth, commission of high crimes due to involvement in extrajudicial killings, betrayal of public trust due to alleged destabilization plots, and betrayal of public trust due to her unbecoming conduct as Vice President.
