ICC grants Duterte's request to defer decision on interim release

The International Criminal Court’s (ICC) Pre-Trial Chamber I (PTC I) granted former president Rodrigo Duterte’s request to defer the adjudication on his interim release petition.

The decision was made by the majority of the judges, with Judge María del Socorro Flores Liera dissenting.

In a filing made public on July 23, signed by Presiding Judge Julia Antoanella Motoc and Judge Reine Adélaïde Sophie Alapini-Gansou, said that the PTC I “defers the issuance of a decision on the Interim Release Request until further action is undertaken by the Defence on the matter, or until when the Chamber will deem it appropriate.”

The decision explained that an interim release application “may exclusively be triggered” by the detained suspect, who has the sole right to submit a request to be temporarily released.

“Accordingly, and to ensure that a decision on the Interim Release Request is appropriately informed, the Majority considers it appropriate, in the circumstances, to defer the issuance of its decision on the Interim Release Request until further action is undertaken by the Defence on the matter, or until when the Chamber will deem it appropriate,” it added.

However, the Chamber also stressed that the decision to defer the ruling on Duterte’s interim release application “shall not be construed as prejudging any matter to be determined in the context of the proceedings related to the Interim Release Request, including in its eventual decision thereon.”

On July 14, the defense requested that the PTC I defers its decision on the interim release application until it is able to submit all necessary information.

This came more than a month after the filing the “urgent request for interim release” on June 12.

Duterte is facing crimes against humanity of charges and has been detained since he was arrested and extradited to The Hague, Netherlands.

He is scheduled for a confirmation of charges hearing on Sept. 23, but the Duterte camp remains hopeful that the former chief executive will be temporarily released from detention before then.
