QCPD files raps vs gun owner linked to robbery that killed police officer

The Quezon City Police District (QCPD) has filed criminal charges against a registered gun owner whose firearm was used in a robbery that resulted in the death of a police officer and injuries to two civilians in Barangay Commonwealth, Quezon City.

Authorities said the 9mm pistol used in the crime was registered to Hernando Dela Cruz Robes, a resident of San Jose del Monte, Bulacan. Records show that Robes owned three firearms, including the one involved in the incident. 
The license for the said firearm expired in March 2014.
Robes’ sons initially told investigators that the gun had been sold to a certain Manuel Marcos Mercado in March 2023. 
However, it was later confirmed that Mercado did not possess a License to Own and Possess Firearms (LTOPF), and his firearm license had expired in August 2007. 
The Firearms and Explosives Office (FEO) had marked it as “License Revoked.”
Further investigation revealed that Mercado had passed away on May 11. His widow confirmed knowing Robes personally, describing him as her husband’s “shooting buddy.” Witnesses also validated their signatures on the deed of sale and confirmed the transaction between Robes and Mercado.
Despite the deed being notarized, the FEO said the firearm remains officially registered under Robes' name, making him legally accountable for its use.
Following the developments, Robes voluntarily surrendered his two remaining firearms to the QCPD for safekeeping.
Robes will face charges for violations of Republic Act No. 10591, also known as the Comprehensive Firearms and Ammunition Regulation Act—specifically Section 41 (illegal transfer of firearm ownership) and Section 32 (unlawful sale or disposition of firearms).
The gun was used in a shootout on June 30 along Katipunan Avenue, Barangay Commonwealth, where Patrolman Harwin Curtney Baggay of the QCPD’s District Tactical and Motorized Unit (TMU) and 33-year-old robbery suspect Rolando Capin Villiarete of Barangay Payatas were killed. Two bystanders were also injured in the shootout.

“Our goal is to uphold the law, and in doing so, we call for the continued support and trust of the public as we work together to maintain peace and ensure the safety of our communities,” Silvio added.
