Duterte's case at the ICC is still at the pre-trial phase, where the prosecutor prepares to seek confirmation of charges, which would move the case toward trial.
On Feb. 10, the ICC’s Office of the Prosecutor applied for an arrest warrant against Duterte for “crimes against humanity of murder, torture, and rape.”
On March 7, the ICC issued the warrant under seal, which was made public on March 11. Duterte was surrendered to The Hague on March 12, following his arrest by Philippine authorities.
Duterte’s initial appearance before the Pre-Trial Chamber took place on March 14 via video link.
The Pre-Trial Chamber has since stated that there are reasonable grounds to believe Duterte is “individually responsible as an indirect co-perpetrator” for the alleged crimes committed in the Philippines from Nov. 1, 2011, to March 16, 2019.
The Prosecution must complete all evidence disclosure by July 1, ahead of the scheduled confirmation of charges hearing on Sept. 23, as directed by ICC Pre-Trial Chamber I.
