Comelec issues finality of ruling in reinstating Marcy Teodoro's candidacy

The Commission on Elections (Comelec) En Banc has officially declared the finality and immediate executory effect of its resolution reinstating the candidacy of Marcelino “Marcy” Teodoro as member of the House of Representatives in Marikina City's 1st District.

The ruling reverses a previous decision by the Commission First Division. It grants the consolidated motions for reconsideration filed by respondent Teodoro, thereby denying the petitions filed by former Senator Aquilino “Koko” Pimentel III, Katrina Mari Faye Marco, Angelu Estanislao, and Ma. Luisa de Guzman to cancel his Certificate of Candidacy (COC).
“Wherefore, premises considered, the Commission (En Banc) Grants the Consolidated Motions for Reconsideration. The Resolution dated 11 December 2024 promulgated by the Commission (First Division) is hereby reversed and set aside,” the Commission En Banc said in the Certificate of Finality and Entry of Judgement dated July 1, 2025.
The Comelec En Banc ruling lifts the prior suspension order against Teodoro’s CoC.
“The Order for the suspension OF the proclamation of respondent Marcelino 'Marcy' R. Teodoro issued by the Commission (En Banc) on 12 May 2025 is HEREBY LIFTED. Finally, the Certificate of Candidacy of herein RESPONDENT MARCELINO ‘MARCY’ R. TEODORO for Member of the House of Representatives, 1st District, Marikina City in the 12 May 2025 National and Local Elections is hereby REINSTATED.”
Comelec further confirmed that the Resolution is now final and executory, as no restraining order was issued by the Supreme Court within the five-day window after promulgation.
“NOW THEREFORE, in view of the foregoing, the Resolution of the Commission (En Banc) promulgated on 25 June 2025 is hereby declared IMMEDIATELY EXECUTORY under the COMELEC Rules of Procedure, and COMELEC Resolution No. 11046.”
Earlier, the poll body lifted the suspension of the proclamation of Teodoro as the winning congressional candidate for Marikina City’s 1st District, following the reinstatement of his COC.
In a 38-page resolution promulgated on June 25, the COMELEC En Banc granted Teodoro’s consolidated motions for reconsideration and reversed the First Division’s December 11, 2024 ruling that canceled his CoC. The En Banc found that the petitioners failed to prove that Teodoro committed material misrepresentation regarding his residency in Barangay San Roque, 1st District.
Teodoro topped the May 12 congressional election in Marikina City’s 1st District with 75,062 votes against Pimentel.
