House prosecutors in Vice President Sara Duterte's impeachment case may elevate matters to the Supreme Court (SC) if senator-judges vote to outright dismiss her impeachment complaint and skip her trial entirely.
Lawyer Antonio Audie Bocoy, the spokesman for the prosecution panel, on Friday, June 27, said they can't do anything if members of the impeachment court decide to vote in favor of a possible motion to dismiss the impeachment case without trial.
'Yung ilalagay nila sa boto 'yan, 'di namin mapipigil 'yan kasi sila po yung husgado eh (If they vote on it, we won't be able to stop it because they are the judges), he said in a press conference.
At any rate, Bucoy said they still trust the process of impeachment.
They also believe that senator-judges will perform their constitutional duties and abide by their oath.
But if there is no recourse left, he said, prosecutors might escalate it to the SC.
''Later on, 'pag nangyari yan, maaaring umakyat kami sa [SC]. Wala tayong magagawa kung mas matagal [yung magiging proseso]. Nandyan na yung sitwasyon eh (Later on, if that happens, we might go to the [SC]. We can't do anything if it will take even longer. This is already the situation we're in),'' he said.
''Di naman pwede na tanggapin na lang natin, eh so we will find recourse. Pero hopefully, hindi tayo aabot dun(We cannot just accept it, so we will find recourse. But hopefully, we will not come to that).''
