Use of vaporized, non-nicotine products in indoor places prohibited, DILG reminds LGUs

The Department of the Interior and Local Government (DILG) reminded on Monday, June 2, the local government units (LGUs) of the ban on the use of vaporized and non-nicotine products in indoor public areas and the sale to non-smokers and persons under 21 years of age.

In a statement, the DILG noted that the prohibition is in effect in public indoor places like elevators, stairwells and the like.

With the prohibition, the DILG urged the LGUs nationwide to pass ordinances to beef up enforcement of laws on tobacco products in line with the directive of President Ferdinand ‘Bongbong’ Marcos, Jr. on smoking and vaping.

“Pass ordinances that support the enforcement of national laws regulating tobacco, vapor, and vaporized nicotine products,’’ the DILG stated.

In a memorandum circular, the DILG stressed that local legislation must align with national laws, and LGUs must not set separate standards on the sale, manufacture, and distribution of these products.

“LGUs are directed to actively enforce Republic Act (RA) 9211 (Tobacco Regulation Act of 2003), RA 11900 (Vaporized Nicotine and Non-Nicotine Products Regulation Act), RA 10643 (Graphic Health Warning Law), and related laws including RA 11467 and RA 10351,’’ it added.

Further, the DILG encouraged the LGUs to adopt rules on smoke-free environments, designated smoking areas, and the display of graphic health warnings.

“LGUs are also expected to coordinate with the Bureau of Internal Revenue (BIR) on enforcing the floor price or minimum price for vapor products and nicotine salts in local markets,’’ the DILG continued.
