Duterte Youth and Bagong Henerasyon (BH) Party-lists said it was only several hours prior to Monday's event that they were informed about the suspension of their proclamations.
The Duterte is facing a five-year petition for disqualification over alleged misrepresentation; while BH is facing a violation of 261 (i) of the Omnibus Election Code, which pertains to the provision prohibiting the intervention of public officers and employees.
Duterte Youth questioned why Comelec made a decision on a 2019 case, when in the past two elections, the party-list was allowed to take its seat in the House of Representatives.
"Comelec mentioned that 'due to the serious allegations' in a case filed by the leftist Kabataan Party-List in 2019, Duterte Youth Party-List’s proclamation today will be suspended," Duterte Youth said.
"If the allegations of Kabataan Party-List was 'very serious' in 2019, why did Comelec allow Duterte Youth Party-List to assume in Congress after the 2019 elections, be elected again and assume in Congress after the 2022 elections, and be elected again in the 2025 elections wherein millions of Filipino Voters elected Duterte Youth Party-List to be their representatives in Congress," it added.
The Duterte Youth Party-List says it is not the group's fault if Comelec did not dismiss the “hao shao case” after its the last hearing in 2019.
"Now, Comelec is trying to subvert the votes of the Filipino People by delaying an election proclamation," it said.
Meanwhile, Kabataan Party-list congresswoman-elect Renee Co, who also won during the May 12 polls, gave terse remark over Duterte Youth's proclamation woes.
"Deserve," Co said.
Duterte Youth said its chairman, Ronald Cardema, will challenge Comelec's "grave abuse of disrection" before the Supreme Court (SC).
Meanwhile, BH Party-list Rep. Bernadette Herrera said they neither received a warning nor a prior notice from Comelec regarding its decision.
She said the party-list has not been informed of the supposed case, so she asked, "How can we be held to account for an accusation that remains invisible—unnamed, unheard, and unexplained?"
"And more importantly: how can 319,803 Filipinos be silenced so easily?" she said.
Herrera asserted that Comelec's own rules were clear that a proclamation shall proceed unless a case is resolved with finality.
"In this case—where no complaint has even been furnished to us, much less ruled upon—how can a suspension be justified?" she asked.
"We ask not just for fairness, but for respect—for the vote, for the voice, for the will of the Filipino people," she added.
Herrera said BH was ready to respond to any complaint, anytime, anywhere.
"But until such a complaint is properly disclosed and due process is afforded, the suspension of our proclamation—and the disenfranchisement of 319,803 voters—is not only unjust. It is unconstitutional," she added.
