ERC issues show-cause orders to 37 allegedly non-compliant GenCos

The Energy Regulatory Commission (ERC) has issued a total of 40 show-cause orders to 37 generation companies (GenCos) after they failed to submit complete fuel purchase documents.
These documents are necessary to ensure fair electricity prices charged to consumers.
In a statement, the ERC said that it is seeking the explanation of 37 GenCos that failed to act on the ERC’s letter-orders issued from December 2022 to March 2024.
The letter-orders had sought complete sets of fuel cost data and documents, covering the period January to October 2022.
The GenCos that have been issued with show-cause orders are:
1. Anda Power Corp. (APC)
2. Angeles Power Inc. (API)
3. Bukidnon Power Corp. (BPC)
4. Calamian Islands Power Corp. (CIPC)
5. Delta Power Inc. (DPI)
6. DMCI Power Corp. (DPC)
7. DMCI Masbate Power Corp. (DMCI-MPC)
8. KEPCO SPC Power Corp. (KSPC)
9. King Energy Generation Inc. (KEGI)
10. Masinloc Power Partners Co. Ltd. (MPPCL)
11. Minergy Power Corp. (MINERGY)
12. Nickel Asia Corp. (NAC)
13. North Bukidnon Power Corp. (NBPC)
14. OrMin Power Inc. (OPI)
15. Palawan Power Generation Inc. (PPGI)
16. Panay Energy Development Corp. (PEDC)
17. Peakpower Soccsargen Inc. (PSI)

Some of the GenCos included in the list were owned by Aboitiz Power Corp., San Miguel Corp., and DMCI Holdings Inc.

According to DPC and DMCI-MPC, they are in the process of verifying records on their alleged non-compliance with the mandate.

“We remain fully committed to regulatory compliance and transparency in our operations and will cooperate with the ERC to address the matter accordingly,” DMCI stated.

While the rest have yet to issue their statements, the ERC ordered these GenCos to submit the required documents and a verified explanation within 15 days from the receipt of the decision.
Furthermore, the GenCos were instructed to justify why they should not be slapped with any administrative penalty after their failure to comply.
“Fuel invoices must be submitted on a monthly basis to support pass-through fuel costs reflected in the billings of GenCos. These invoices are necessary for DUs [distribution utilities] to verify whether the volume, price, and efficiency rates of pass-through costs fall within the formula and cap prescribed by the Commission in the order or decision approving the implementation of their PSAs [power supply agreements],” the ERC explained.
Moreover, the ERC said that if there is no sufficient basis, fuel costs cannot be charged to consumers or be refunded if they are billed.
ERC Chairperson and Chief Executive Officer (CEO) Monalisa Dimalanta said that this move would help lead to fair and reasonable power costs.
“We owe it to the Filipino consumers to protect them from unnecessary charges and ensure that they’re not paying more than they should for electricity,” she said.
“We likewise remind GenCos and DUs to fully cooperate and comply with these requirements, so we can uphold transparency and deliver power at the least cost possible," Dimalanta added.
