VP Sara, FPRRD discussing options for mayoral oath-taking amid ICC case

DAVAO CITY – Vice President Sara Z. Duterte confirmed on Monday morning, May 12, ongoing discussions with the legal teams of former President Rodrigo R. Duterte regarding how he may officially take his oath as mayor here should he win in the midterm elections.

Vice President Duterte said they have been discussing with the former Chief Executive’s lawyer at the International Criminal Court (ICC) and his Philippine lawyer about how her father can take his oath as the winner of the mayoral contest in the midterm elections here.
“We discussed it a few days ago and came up with three options about how he might be able to take the oath. According to his ICC lawyer, once they receive the proclamation documents, we’ll revisit the discussion on how the former President can take his oath,” the Vice President said.
Vice President Duterte added that the process — from election to proclamation to oath-taking — is currently on hold for now pending further coordination. She said they have until noon on June 30 for former President Duterte to take his oath.
The Vice President acknowledged the absence of the former Chief Executive from the city once he officially assumed his post. She emphasized that his father would not be here since he was kidnapped and detained at a detention facility in The Hague for alleged crimes against humanity.
“There is no legal issue without the former President as the city mayor. Our laws, especially the Local Government Code, clearly state that the vice mayor automatically becomes the acting mayor if the mayor is absent. The law is clear on that,” Vice President Duterte said.
She also revealed that the elder Duterte is sad as he was unable to vote this year. She said that the former Chief Executive could not exercise his right to vote because he had not registered for absentee voting, despite his lawyers' efforts to ask the Commission on Elections on the matter.
“From what I understand, his lawyers tried to ask the Comelec if there was a way for him to vote outside of the absentee voting law, but unfortunately, that was the only option available. Since he wasn’t registered, he couldn’t exercise his right to vote,” she said.
Vice President Duterte recounted a recent phone conversation with former President Duterte on her visit to Batangas. She said her father asked about the progress of the campaign and about the chances of the 10 senatorial candidates.
She added that she gave her father realistic numbers. In response, he said, “If those are the numbers, let us leave the miracles to God.” The Dutertes have been endorsing the “DuterTen” senatorial lineup under the Partido ng Demokratikong Pilipino-Lakas ng Bayan.
With the campaign season over, Vice President Duterte said she would keep an eye on former President Duterte’s ongoing legal case following his father’s request. She added that she will do this and also push through with the rollout of their flagship “Pagbabago Program.”
