- The facilities were reopened by the Taguig City government
A Taguig Regional Trial Court (RTC) extended a temporary restraining order (TRO) that directed the Makati City government to cease obstructing the Taguig City government from accessing and possessing government facilities in the EMBO (enlisted men’s barrio) barangays.
In an order dated May 8, Presiding Judge Desiree Gertrude Orquiola-Moldez of the Taguig RTC Branch 163 granted a 17-day extension of the earlier 72-hour TRO issued by Executive Judge Loralie Cruz Datahan, citing the urgency and gravity of depriving EMBO residents of essential services.
The covered facilities include health centers, covered courts, multi-purpose buildings, day care centers, parks, and other government properties reserved for public use under Proclamation Nos. 518 and 1916.
The Supreme Court previously issued a decision transferring 10 EMBO barangays from Makati to Taguig. These are Cembo, Comembo, Pembo, East Rembo, West Rembo, South Cembo, Pitogo, Post Proper Northside, Post Proper Southside and Rizal.
Makati closed health and day care centers in EMBO barangays.
“The plaintiff [Taguig] and its residents are being deprived of their full and free rights and benefits... because of defendant’s continued unlawful possession,” Taguig’s complaint read.
In the TRO extension, Orquiola-Moldez wrote, “Facilities intended for the health, well-being, and general welfare of residents were closed or restricted, at the expense of the public.”
The court stated that the TRO extension was necessary to prevent further harm to the residents and to allow Taguig to begin operating and maintaining the facilities “for the benefit of its constituents.”
With the TRO extension, Taguig can continue its administrative control over the facilities covered by the ruling for the duration of the TRO.
Taguig is also praying for a preliminary injunction while the merits of the case is pending resolution.
