In Labor Advisory No. 3, series of 2025, DOLE Secretary Bienvenido E. Laguesma clarified that May 12 has been declared a special non-working holiday in observance of the National and Local Elections, as stated in Presidential Proclamation No. 878 signed by President Ferdinand Marcos Jr.
Laguesma explained that employees who opt not to work on May 12 will be subject to the “no work, no pay” principle, unless a company policy, practice, or collective bargaining agreement (CBA) provides otherwise.
Employees required to work beyond eight hours on Election Day shall receive an additional 30 percent of their hourly rate.
Those who render service on their scheduled rest day will be entitled to an extra 50 percent of their basic wage for the first eight hours.
Work performed beyond eight hours on a rest day shall be compensated with an additional 30 percent of the hourly rate for the excess hours.
