DTI temporarily suspends online selling of vape

The Department of Trade and Industry (DTI) will temporarily suspend the online selling of vape products.

In its Department Administrative Order No. 24-03, the DTI said that it will temporarily suspend the online sale, distribution, and advertising of vapor products, and their devices and systems through their respective electronic marketplaces and online merchants.

The suspension will be lifted once the merchant has presented and submitted, to the satisfaction of DTI, adequate and effective measures ensuring compliance with the proof-of-age verification and all other mandatory legal requirements of Republic Act No. 11900 or the Vaporized Nicotine and Non-Nicotine Products Regulation Act.

Under the law, sellers are not allowed to sell their vape products to individuals below 18.

The DTI also orders the submission for these merchants of necessary IDs, permits and licenses, including but not limited to, valid government-issued IDs, business permits from the corresponding local government unit, registration with the DTI, Securities and Exchange Commission (SEC) or Cooperative Development Authority (CDA) and registration with the Bureau of Internal Revenue (BIR).

It also said that there should be a contract between them and each of the online merchants in their respective electronic marketplace on the sale procedures and limitations for the sale, procedures, limitations, and other relevant conditions for the vape products.

Meanwhile, they should also ensure that their products are listed or to be listed on their respective electronic marketplaces and have the necessary registration, license or permit, graphic health and fiscal markings, and proof of compliance with all other mandatory standards required by existing laws and regulations.

In addition, the entity operating the online marketplace should also be provided access to, or copies of the pertinent documents and records upon request or inspection by authorized officers or employees of the DTI.

DTI also said that online marketplaces must adopt necessary measures to ensure continued compliance with the law and rules.
