Benitez, through his spokesperson, lawyer Caesar Distrito, assured the suspects that their rights will be respected and they will be afforded all the legal remedies that they are entitled to in accordance with the law and Constitution.
He sympathized and condoled with the parents of 20-year-old Nicus Balagosa who was shot in front of his parents in their residence in Barangay Granada on June 2, days before his 21st birth anniversary this month.
“I cannot imagine the pain and sufferings of Nicus’ parents that their only child, was shot and killed in their presence, and in their own home,” Benitez said in a statement.
According to the police, Balagosa was falsely accused as one of those who raped a 16-year-old friend.
Benitez directed Police Col. Noel Aliño, Bacolod police director, to ensure the safety of Balagosa’s family who are fearing for their lives following the incident.
He also ordered the police to file an airtight case against the suspects so that justice will be served to the “helpless” victim.
“No matter what, no one has the right to take the life of another, and to put the law in his own hands. That ours is a government of laws and not of men, and therefore we should seek justice through our institution, and not in our means,” Benitez said.

Police are preparing murder cases against the four suspects, including the teenage girl’s father, who was identified as one of the two gunmen who shot Balagosa.
Balagosa and the girl as well as their two other friends aged 17 and 19 attended a friend’s birth anniversary party when the alleged rape happened.
Police said that based on their investigation, Balagosa had left the party before the incident happened, prompting them to continue probing their two friends.
Benitez urged the suspects to surrender to authorities.
