DU30 could be held liable for reckless call on Mindanao secession -- ex-OVP spox

Even ordinary Filipinos can file a case against former president Rodrigo Duterte for his call for Mindanao’s secession, former lawmaker Barry Gutierrez said.

In a recent interview on DZRH, the ex-spokesman of former vice president Leni Robredo pointed out that either the president, the government, or ordinary Filipinos can put the former chief executive to task.
 

"Sa ilalim ng Revised Penal Code, ‘yung mga ganoong klaseng panawagan, pwede nang ituring ‘yan na violation ng Article 142 yung inciting to sedition (Under the Revised Penal Code, those kinds of statements, that can be considered a violation of Article 142 or inciting to sedition)," he explained.
 

Gutierrez recalled that the former president, in a speech during an anti-Cha-cha rally in Davao City last month, asked the military to act against any attempts to change the Constitution. Duterte also said that Mindanao should be separated from the rest of the country. 
 

“Sa ilalim ng ating [saligang] batas naman basta krimen ay kahit sino pwedeng magsampa ng reklamo hindi kailangang gobyerno (Under our Constitution, if it’s a crime, anyone can file a complaint, it doesn’t need to be the government),” he said.
 

“Kung sino mang nakarinig ‘nun, kung sino mang nagsusubaybay at medyo naalarma duon sa sinabi ni dating Pangulong Duterte, posibleng magsampa ng reklamo (Anyone who heard that, whoever watched and was alarmed by what former President Duterte said can possible file a case).”
 

The Revised Penal Code's Article 142 deals with acts that could weaken the government or encourage citizens to engage in movements aimed at overthrowing it or altering the country's territorial integrity.
 

Duterte’s statements were made as he also accused President Marcos of being a “drug addict” and “bangag (high on drugs)” amid a push for People’s Initiative (PI) to amend the Constitution supposedly being led by the President’s cousin, House Speaker Martin Romualdez.
 

It was alleged that the move can perpetuate Marcos to power and block Vice President Sara Duterte’s path to the presidency.
