Popular Panglao beach resort padlocked

CEBU CITY—A popular resort hotel in Panglao, Bohol was shut down for operating without a business permit.



 

Municipal officials, led by Panglao Mayor Edgardo Arcay, served the closure order on Villa Tomasa Q on Tuesday morning, April 16.



 

Arcay said the hotel has been operating without a business permit despite several notices from the municipal government to obtain it.



 

“We have to shut it down. If something happens to their guests, who will be answerable when they don’t have a permit to operate?” said Arcay.



 

The main entrance of the hotel was padlocked after the closure order was served.



 

The hotel was known as Alona Kew White Beach Resort until it was leased to the Cebu City-based Guardo family.



 

Dondon Guardo was around when the closure order was served. He told Arcay that the hotel didn’t have a business permit as it was not processed by the lessors.



 

“The municipal government has nothing to do with your issues with the lessors,” Arcay told Guardo.

The hotel is owned by spouses  Eteria Evelyn Naval-Flores and Magileo Wilfredo D. Flores. 



 

According to the couple, it was sometime in January last year when the Guardos proposed that they were willing to lease the Alona Kew White Beach Resort for P10 million a month.



 

The contract of lease with option to purchase was signed on January 30, 2023.



 

The conflict between the two parties started when the Guardos allegedly became delinquent with their monthly rentals.



 

The owners claimed that after several failed payments and bounced checks, they sent letters to the lessees demanding payment of the rental arrears which had ballooned to P63.8 million.



 

The owners decided to terminate the contract of lease after the Guardos violated the contract for failing to pay rent for two successive months.



 

In several meetings, the Guardos tried to restructure the contract but was turned down by the owners.



 

On March 27 this year, the owners sent their third letter to the Guardos formally rejecting their counter-proposal and demanding for them to pay their balance and vacate the premises.



 

The owners lamented that instead of honoring the contract, the lessees refused to vacate and surrender the premises and stopped paying rent.



 

The owners added that the lessees deployed more security personnel in the hotel and prevented their personnel from entering when they tried to take over.



 

It was only during the serving of the closure order that the owners were able to take over the hotel.



 

The conflict between the owners and the lessees was noted in the closure order.



 

Arcay said renewal of the business permit was already impossible as the lessors were unwilling to issue a lessor permit.
