Zubiri expresses need for special law vs road rage during QC incident probe

Senate President Juan Miguel F. Zubiri expressed the need to come up with a special law against road rage after the gun-toting incident that occurred in Quezon City involving a cyclist and a former policeman.

During the hearing of the Senate Committee on Public Order and Dangerous Drugs on Tuesday, Sept. 5 chaired by Sen. Ronald “Bato” dela Rosa, Zubiri said that it's very important for them to know what steps to take to avoid incidents such as this from happening again.
He mentioned, however, that it is unfortunate that cyclist Allan Bandiola did not file any charges out of fear for his life and his family.
"What we need to do Mr. Chairman is come up with policy and possibly a special law that will be against road rage on its own. We can come up with a special law," Zubiri told Dela Rosa.
"It will become the burden of the government to file a case against these individuals," he added.
On the other hand, lawyer Raymond Fortun, who was also at the hearing, said that if it's just "People of the Philippines" there might be a problem since the courts will always try to convict on the basis of the existence of proof beyond reasonable doubt and it can be dificult to achieve that level of standard if there will be no witness who will testify.
He mentioned if there is a way for the senate to increase funds of barangays to have CCTVs installed.
"Kasi kung ganyan ulit na walang testigo actually pupwede pa rin po na yung taong makagawa ng krimen ay mapapapanagot natin sa mga husgado (If that type of incident will happen again where there's no witness, the culprit can still be made to answer) because there is proof," he added.
The road rage incident involving Wilfredo Gonzales, a former police officer, and the Bandiola occurred at around 6 p.m. on Aug. 8. at the corner of Quezon Avenue and Welcome Rotonda. The viral video showed Gonzales hitting Bandiola and pulling out a gun during their confrontation.
During the hearing, Bandiola stated that they parted amicably after settling the matter on the same day it happened. He added that they even shook hands and hugged before leaving the police station. He also said that the police extended assistance fairly and even offered him dinner before leaving since they were there for hours.
