LIPA CITY, Batangas – A 63-year-old foreman died and his daughter was injured when a tree fell on them while they were on board a motorcycle in Barangay 7 here on September 20.
“Julie,” 35, the daughter of the victim, Sammy Aplaon, a resident of Barangay 7, told police Tuesday, September 26, that the incident happened at 5:48 p.m. on Sampaguita St., Purok 4, Barangay 7.
She said that they were traversing the area when an acacia tree suddenly fell and hit them. They were thrown away and sustained injuries.
They were taken to a hospital here where the elder Aplaon was declared dead. Julie was transferred to another hospital in this city afterwards.
Police conducted an investigation and found out from the Register of Deeds here that the acacia tree was owned by Tolentino Tobias and Pacencia Marcial.
Police are preparing a complaint for reckless imprudence resulting in homicide, physical injury, and damage to property against Tobias and Marcial.
Lawmen are not discounting a possible amicable settlement on the case.
