Such is the question on the minds of observers in Congress following the Commission on Appointments' (CA) announcement of Herbosa's confirmation hearing, which is set on Sept. 26.
Of the Cabinet level officials of the Marcos administration, Herbosa is the only one yet to be confirmed. He is also among the newest appointees, having only been tapped in early June.
CA member Marcoleta had some very strong words about Herbosa late last month, when he admonished the latter for supposedly making statements that were contrary to the President’s plan to promote the Philippines an export hub for heated tobacco products (HTPs).
"Our new DOH secretary should be a team player and should know his place in this administration. If he cannot work in cadence with the President's men, Secretary Herbosa should not have accepted the DOH post," Marcoleta said.
The former deputy speaker went as far to say that if Herbosa wants to secure his confirmation as DOH chief, he should learn to respect the rule of law and abide by existing laws and state policies enacted by Congress (House of Representatives and Senate).
Congress will close session on Sept. 29 and adjourn from Sept. 30 to Nov. 5, before resuming session on Nov. 6. The 25-member CA is composed of both House members and Senators.
“The CA’s Committee on Health chaired by Senator Christopher ‘Bong’ Go will hold its confirmation hearing on Secretary Herbosa’s ad interim appointment on the last Tuesday of September,” CA Assistant Minority Leader and Surigao del Sur 2nd Rep. Johnny Pimentel earlier said in a statement.
The CA has likewise scheduled a caucus and a plenary session on Sept. 26, according to Pimentel.
“Right now, the only presidential appointees awaiting confirmation are Secretary Herbosa and 13 newly promoted senior military officers,” Pimentel said.
The Constitution empowers the CA to scrutinize the competence, suitability and integrity of key presidential appointees, including Cabinet members, and to approve or disapprove them.
Under existing CA rules, an ad interim appointment ceases to be valid upon disapproval by the commission or, if not confirmed, until the next adjournment of Congress.
Herbosa, 64, was DOH undersecretary from 2010 to 2015. He graduated from University of the Philippines College of Medicine and took his post-graduate studies at Tel Aviv University’s Sackler Faculty of Medicine.
Last week, the CA confirmed Gilberto Teodoro Jr.’s appointment as Department of National Defense (DND) Secretary.
