Dads who abandoned kids must pay minimum child support of P6,000 under Tulfo bill

A bill filed by House Deputy Majority Leader ACT-CIS Party-list Rep. Erwin Tulfo sets to P6,000 the minimum amount of monthly child support "deadbeat" fathers must provide their children. 

Tulfo filed House Bill (HB) No. No.8987, or “An Act Punishing the Willful Failure to Pay Paternal Child Support", wherein he expressed his disdain for fathers who neglected or abandoned their children. 

“Dapat managot ang mga tatay na magiging pabaya at hindi magbibigay ng suporta sa kanilang mga anak. Ang kanilang anak ay kanilang tungkulin kaya dapat na masiguro na maayos ang pagpapalaki sa mga bata para sa kanilang kinabukasan,” Tulfo said. 

(Fathers who will neglect and don't give support to their children must be made accountable. Their children is their responsibility, they should be raised properly for the sake of their future.) 

Under the proposed statute, the paternal child support shall be at least 10 percent of the father’s salary, but should not be lower than P6,000 a month or P200 a day. 

“Pero kung magsasampa ng kaso sa korte ang nanay ng bata, depende sa korte kung ano discretion nila based sa kakayahan ng Tatay at depende rin sa dami ng dami ng anak,” Tulfo explained. 

(But if the mother of the child files a case in court, it will be up to the court to decide on the level of child support based on the father's capability and the number of children.) 

The bill proposes a penalty of six to 12 years imprisonment and a fine of P100,000 to P300,000 for fathers who willfully fail to pay child support. 

The author said criminalization of a deadbeat father is already duly provided in Republic Act (RA) No. 9262 or the Anti-Violation Against Women and Children (Anti-VAWC) Act. The withdrawal of child support is considered economic abuse by the law. 

“However, the comprehensive implementation and enforcement of paternal child support, including all other acts to establish the said legal obligation, is still a legislative priority. It is in this regard that this proposed measures seeks to establish the amount of paternal child support and streamline the process in establishing paternity which is prerequisite for a child support order,” the bill read. 

“Ang gusto natin dito ay protektahan ang kinabukasan ng mga bata. Dapat panagutan ng mga magulang lalo na ng mga tatay ang kapakanan ng kanilang mga anak,” Tulfo said. 

(We want to protect the future of the children. The parents , especially the father, should take up responsibility for their children.) 

ACT-CIS Party-list Reps. Jocelyn Tulfo, Edvic Yap; Benguet lone district Rep. Eric Go-Yap and Quezon City 2nd district Rep. Ralph Tulfo also authored the bill.
