A Mandaluyong City court has dismissed the frustrated homicide charges of Jose Antonio Sanvicente, the driver of the sports utility vehicle (SUV) that rammed a security guard last June 5, 2022.
According to the email response of the Mandaluyong City Regional Trial Court Branch 213 to Manila Bulletin’s inquiry, the case was settled and “has been dismissed on Dec. 15, 2022.”
The Sanvicente case drew the public eye when a dashboard camera-recorded video circulated online showing Christian Floralde, a 31-year-old security guard, getting hit and run over by an SUV driven by the suspect while he was directing traffic at the intersection of Julio Vargas Avenue and St. Francis Street.
Floralde sustained fractured ribs and a head injury, and was immediately hospitalized and given medical treatment.
The Mandaluyong police filed frustrated murder and abandonment of one's own victim charges against Sanvicente last June 7, 2022.
On June 10, 2022, Floralde said he will also pursue a case against Sanvicente.
Due to the police’s demands and public pressure, Sanvicente surrendered to the Philippine National Police (PNP) on June 15, appearing in a press briefing at Camp Crame in Quezon City wherein he apologized to Floralde and his family
The charges levelled at Sanvicente were lowered to frustrated homicide by the Mandaluyong City Prosecutor's Office on Aug. 25, 2022.
Last Sept. 7, 2022, Sanvicente pled not guilty during the arraignment at the Mandaluyong Regional Trial Court Branch 213.
