Makati to abide by DepEd's takeover of public schools in 'embo' barangays

The Makati City local government said on Thursday, Aug. 17, that it will abide by the Department of Education's (DepEd) decision to take over the management and supervision of its 14 schools affected by the territorial dispute with the City of Taguig.

"We welcome the decision of Vice President and Education Secretary Sara Duterte to take over the management and supervision of the 14 schools," Makati City Mayor Abby Binay said.

"We look forward to working wholeheartedly with the transition team created by the Vice President. This decision will greatly ease the worries and concerns of our students, parents, and teachers. Kaisa kami ni Vice President Sara sa kanyang layunin. Unahin natin ang kapakanan ng ating mga guro, mga kabataan, at kanilang mga magulang (We are one with Vice President Sara in her advocacy. Let's prioritize the welfare of our teachers, the youth, and their parents)," she added.

On Aug. 16, DepEd issued Order No. 23, Series of 2023, or the "Assumption of Authority of the Department of Education over the 14 public schools affected by Supreme Court decision in G.R. No. 235316".

The agency said the order was issued following the increased tension between the two local government units (LGUs) regarding the management and supervision of the affected schools which poses uncertainty to the peaceful and orderly reopening of classes on Aug. 29.

The affected schools are as follows:

1. Fort Bonifacio Elementary School
2. Cembo Elementary School
3. South Cembo Elementary School
4. Pitogo Elementary School
5. East Rembo Elementary School
6. Rizal Elementary School
7. Comembo Elementary School
8. West Rembo Elementary School
9. Pembo Elementary School
10. Makati Science High School
11. Benigno “Ninoy” S. Aquino High School
12. Tibagan High School
13. Fort Bonifacio High School
14. Pitogo High School

"The subject schools are DepEd schools. Hence, in the pursuit of protecting the best interest and welfare of our learners, teachers, and non-teaching personnel, the Office of the Secretary shall directly supervise the management and administration of all 14 schools, pending a transition plan, effective immediately." the order stated.

DepEd added that a transition team has already been created composed of the following:

- Regional Director (assigned outside of the National Capital Region)
- DepEd Schools Division Superintendent of Taguig-Pateros
- DepEd Schools Division Superintendent of Makati City
- City Legal Officer of Makati City
- City Legal Officer of Taguig

"During the transition period, all activities to be conducted within the premises of and/or in relation to the subject public schools, including those from the Local Government Units of Makati and Taguig, shall require prior approval from the Office of the Secretary (OSec)." It stressed.

On Aug. 12, the Makati City government condemned Taguig City's forcible takeover of some of its public school buildings in the contested barangays of the two local government units (LGUs) following the Supreme Court's (SC's) decision on the boundary dispute between the two cities.

In a statement released by Makati City Administrator Claro Certeza, several "enforcers" allegedly belonging to Taguig's Public Safety Department "attempted to forcibly take possession of several public elementary and high school buildings in the barangays adversely affected by the Supreme Court decision. These 'enforcers', who did not possess any writ of execution or any other lawful order, created unnecessary tension in these areas."

Certeza called Taguig's action as "an act of duplicity and bad faith."

"Earlier, the city government of Taguig wrote the city of Makati requesting discussions for a smooth transition. Makati has already created a transition team headed by the undersigned to sit down with Taguig. We were ready to offer arrangements that would benefit the students. But Taguig apparently was not sincere and was in reality intent on using force," the official said.

"We also wish to inform Taguig that these public schools are properties owned by the City of Makati. The improvements were paid for by the City of Makati. The decision of the Supreme Court involved a boundary dispute. It did not transfer to Taguig ownership of properties owned by the City of Makati," he added.
