Taguig mayor says writ of execution not needed in transfer of EMBO schools


Mayor Lani Cayetano said a writ of execution is not needed for the transfer of Makati public schools to Taguig’s jurisdiction. 

This after Cayetano held the Brigada Eskwela in public schools in EMBO (Enlisted Men's Barrio) barangays in Makati that were declared by the Supreme Court as part of Taguig.

The Makati City government said Taguig needs to secure a writ of execution to effect the transfer of jurisdiction over 10 barangays. 

It quoted a letter from the Office of the Court Administrator to Makati Regional Trial Court Branch 64 Executive Judge Gina M. Bibat-Palamos. 

Court Administrator Raul Villanueva told Judge Bibat-Palamos, “Meanwhile, as an initial assessment, the decision of the Supreme Court's Third Division should be the subject of a writ of execution before the trial court of origin.”

“When the said writ has been implemented by the Department of Interior and Local Government, then that is the reckoning period for the transfer of jurisdiction of cases emanating from the Fort Bonifacio Military Reservation, consisting of Parcels 3 and 4, Psu-2031, from Makati City to the City of Taguig,” he added. 

Makati City Administrator Claro Certeza said Villanueva's response refers to procedures that should be done before the transfer of jurisdiction can be implemented. 

Certeza sent a letter to Judge Bibat-Palamos to seek clarification on the transfer of pending court cases in the 10 affected barangays. Bibat-Palamos replied to Certeza and quoted Villanueva’s response. 

But Cayetano said a writ of execution is not needed. 

“That’s not needed po. Patunay po itong DepEd. Napakalinaw na po e. Government to government naman po tayo. Ano po naman ang kailangan…kakailanganin pa ho iyan. That’s nothing but a delaying tactic,” Cayetano told the media about the Makati City government’s statement. 

She claimed Makati’s “intention is to delay, to distract us para hindi kami maka-focus. Ito na nga 'yung game plan nila (intention is to delay, to distract us so that we will be unable to focus. This is their game plan).” 

Certeza accused the Taguig City government of “unlawful entry in our public schools without securing the necessary legal processes.” 

He said the Makati City government may file criminal and administrative charges against Taguig for taking over properties owned by the city. 

Mayor Abby Binay said the Department of Education memo only addresses the transfer of management and supervision of 14 affected public schools but not the transfer of ownership. 

Binay said the affected schools were built using city government funds. 

In a statement, Cayetano said the issue of ownership or  reimbursement should be deferred as it only distracts the parties from the pressing issues that need to be addressed.
