The Philippine Economic Zone Authority (PEZA) has further streamlined processes and requirements for the Presidential Proclamation of approved economic zone development projects.
PEZA Director General Tereso O. Panga said that the PEZA Board was approved on June 23, 2023 Resolution No. 23-138, took effect immediately upon its publication on Tuesday, July 19, in a newspaper of general circulation. The resolution amended earlier PEZA Board resolutions No. 13-743 on November 29, 2013 and No. 00-263 on August 17, 2000. A PEZA-approved ecozone development project needs a Presidential Proclamation before it can proceed to implementation. Based on the new Resolution 23-138, PEZA has specified all documents required for PEZA Board Pre-Qualification Clearance for the Presidential Proclamation of ecozones. These documents include notarized application form, anti-graft clearance, Securities and Exchange Commission registration certificate, Articles of Incorporation and By-Laws, project description, Board resolution/special power of attorney designating the company’s authorized representative to PEZA, site development plan, documents required for PEZA’s endorsement of a proposed presidential proclamation, proof of land ownership, endorsement of the local government unit, verified survey returns, clearance from the Department of Agrarian Reform, and Environmental Compliance Certificate issued by the Department of Environment and Natural Resources. For applications with investment capital/cost exceeding P1 billion and qualified for incentives, proponents are required to submit a copy of the Fiscal Incentives Review Board (FIRB) resolution granting the appropriate incentive/s approving the PEZA recommended incentive/s to be granted to the proposed project. The PEZA Director General is also authorized to endorse the proposed ecozone directly to the Office of the President for the issuance of the required Presidential Proclamation pursuant to Part III, Rule IV, Section 4 of the Rules and Regulations to Implement RA No. 7916, as amended. PEZA said that the amended resolution is in pursuant to RA No. 11032, or the Ease of Doing Business and Efficient Government Service Delivery Act of 2018, and the directive of the Office of the President (OP) to further streamline the Ecozone Proclamation Process. The new processes will have a retroactive effect on ecozone applications previously granted pre-qualification clearance by the Board and are currently for endorsement to the OP or complying with the requirements for Presidential proclamation. The further streamlined process was passed in light of the pending 27 big ticket ecozone projects worth more than P40 billion that seek to offer locations to investors. Of 27 ecozones registered with PEZA, 19 projects with combined investments of P20 billion have already been endorsed to the OP for Presidential Proclamation. Panga also pointed out that nine out of the 19 ecozones will cater to manufacturing projects. The remaining eight others were registered with PEZA in the January-June period this year with PP33.002 billion investments, lower than the P4.8 billion ecozone investments approved in the same period last year. The new ecozone approvals are located in Cebu, Batangas, Cavite, Makati, South Cotabato, and Quezon City. PEZA is also set to endorse these new projects to the OP for Presidential Proclamation. Earlier, Panga said that streamlining initiative was implemented following instruction by President Ferdinand R. Marcos Jr. “The President instructed the Department of Trade and Industry, PEZA and OP-DESGA (Deputy Executive Secretary of General Administration) to streamline and harmonize the requirements to speed up the presidential proclamation process for ecozones,” said Panga.
