SC orders NBI to answer plea for release of 1 of 11 detained suspects in Degamo slaying

The Supreme Court (SC) has ordered the National Bureau of Investigation (NBI) to answer the plea for release filed by the mother of one of the 11 detained suspects in the March 4, 2023 killings of Negros Oriental Gov. Roel R. Degamo and nine other persons. The plea was contained in the petition for a Writ of Habeas Corpus filed by Conchita, mother of detained suspect Marvin H. Miranda, a military reservist who had earlier been tagged as “one of the masterminds” in the killings. Justice Secretary Jesus Crispin C. Remulla had said that Miranda “has a very strong connection” with Negros Oriental 3rd District Rep. Arnolfo “Arnie” A. Teves Jr. who had also been tagged as “mastermind” in the Degamo slaying.  Teves has denied the allegation. A Writ of Habeas Corpus “is a writ directed to a person detaining another, commanding the former to produce the body of the latter at a designated time and place.” It extends “to all cases of illegal and arbitrary detention by which any person is deprived of his liberty….” In her petition, Conchita asked the SC to order the release of her son and to prohibit the NBI “from committing or attempting to commit any act violative of his rights.” At the same time, the mother asked the SC to order the NBI to suppress the evidence gathered during the alleged illegal arrest of his son. Earlier, Remulla had said that Miranda was arrested by the NBI last March 31 during hot pursuit operations since the March 4 killings. Last May 31, the Manila regional trial court (RTC) postponed the arraignment of Miranda and 10 other suspects on 10 counts of murder, 12 counts of frustrated murder, and three counts of attempted murder under the Revised Penal Code. Aside from Miranda, the other detained suspects are Rogelio C. Antipolo Jr., Jhudiel R. Rivero, Romel A. Pattaguan, Dahniel P. Lora, Joven C. Javier, Winrich B. Isturis, John Louie L. Gonyon, Eulogio L. Gonyon Jr., Joric G. Labrador, and Benjie Rodriguez. Cases in the killings of Degamo and nine other persons have been transferred to Manila on orders of the SC.
