BIR files tax evasion case vs buyer and seller in land deal

The Bureau of Internal Revenue (BIR) has filed a tax evasion case against a buyer and seller of two parcels of land in Pampanga with a zonal value of P10 million for alleged failure to pay the required capital gains and documentary stamp taxes.
In a criminal complaint submitted to the Angeles City Prosecutor's Office, North Pampanga Revenue District Officer Charmaine Dela Torre identified the respondents as Cynthia Lu Chan and Cesar Ramirez.
According to the complaint, the properties' ownership was transferred to buyer Ramirez through the submission of a counterfeit Certificate Authorizing Registration (CAR) to the local registry of deeds.
This allowed the seller, Chan, to evade payment of the said taxes amounting to P750,000, the BIR noted.
If found guilty of tax evasion charges, the accused individuals could face imprisonment for up to 10 years.
Furthermore, they may also be subject to an additional sentence of up to six years for the presentation of a fake CAR, which is a violation of Section 257 (B)(8) of the tax code.
