Sandigan affirms graft conviction of Postal Savings Bank manager
The Sandiganbayan has affirmed the conviction for graft of Philippine Postal Savings Bank, Inc. (PPSBI) Manager Rosemarie Preston Villamora of the bank’s Naga City branch.
In its Jan. 20, 2023 decision, the anti-graft court found Villamora guilty of violating Section 3(e) of Republic Act No. 3019, the Anti-Graft and Corrupt Practices Act. She was sentenced to six to 10 years imprisonment and was imposed a civil liability of P39,050,000.
She was found to have given unwarranted benefits in 2008 to Noel A. Antonio and other clients by offering and allowing them to invest in the bank's Premium Savings Plan and earn three percent per month or 36 percent per annum, contrary to the regular interest rate of 0.250 percent per annum for peso deposit accounts.
As a result, these account holders unjustly earned roughly P39,050,000 in the form of accrued interests from 2013 to 2017.
Villamora filed a motion for reconsideration and asked for a new trial, stating that there are pertinent documents such as the notarized sworn statement and passbooks that need to be admitted as evidence. She also asked that her conviction be reversed and that she be acquitted of the crime.
However, the anti-graft court denied her motion in a resolution dated last March 24. "We find that the arguments relied upon by the accused in her motion have already been exhaustively considered and passed upon in the assailed decision," the court said.
"There is no need to 'cut and paste' pertinent portions of the assailed decision or re-write the ponencia in accordance with the outline of the instant motion," it added.
Associate Justice Arthur O. Malabaguio write the four-page resolution with the concurrence of Second Division Chairperson Oscar C. Herrera Jr. and Associate Justice Edgardo M. Caldona.
