Palace says elderly jeepney driver must answer charges, will get 'due process'

By Genalyn Kabiling A detained elderly jeepney driver must face the charges against him regardless of his age, Malacañang said Tuesday. Presidential spokesman Harry Roque made the statement after assuring that due process will be given to the accused jeepney driver. They were reportedly charged with resistance and disobedience to authority. While his companies were allowed to post bail, Cordero remained in detention supposedly on account of a pending estafa case. "Dadaan po ‘yan sa proseso. Dadaan po ‘yan sa piskalya, at kung wala pong ebidensya, madidismiss po ‘yung kaso (That will undergo due process, it will be handled by a fiscal and if there is no evidence, the case will be dismissed)," Roque said in a Palace press briefing. On the clamor to release the elderly from jail, Roque maintained that old age does not exempt a person from facing charges under the judicial system. “Titignan po natin ‘yan kasi regardless of your age, kapag may pending case, kinakailangan harapin ‘yung kaso. Magkakaroon lang po ‘yan ng clemency if he is found guilty. Meron tayong probisyon that the court can recommend pardon or parole to senior citizens (We will look into it because regardless of your age, when you have a pending case, you must face the case. There can only be clemency if he is found guilty. We have a provision that the court can recommend pardon or parole to senior citizens)," he said. Roque however pointed out that the person can only be detained between 12 to 36 hours depending on the gravity of the offense. If no charges are filed by then, the person must be released from detention.
