DOJ remains hands off over NBI probe of Vico

Earlier, NBI Deputy Director Ferdinand Lavin revealed that the NBI’s Anti-Graft Division is investigating Sotto for allegedly “disobeying national government policies or directives in imposing quarantines” in violation of the Republic Act 11469, the Bayanihan To Heal As One Act, which President Duterte signed on March 24. Sotto allegedly allowed the operation of tricycles in Pasig City despite government directives to suspend public transportation due to the enhanced community quarantine. Lavin defended the decision of the NBI to investigate Sotto amid arguments that the law cannot be applied retroactively since Sotto has already assured compliance even before Duterte signed the Bayanihan Act. “May hawak ang aming imbestigation na meron continuous tricycle operations na ipinatutupad (Our investigation has evidence that tricycle operations still continue),” Lavin said. “Yung sinasabi na walang retroactive effect, yes we know that. Kaya nga nilagay namin yun continuous tricycle operation (We know that laws have no retroactive effect. That’s why we indicated that continuous tricycle operations have been found),” he explained.
