CJ Peralta says courts functioning despite COVID-19

Peralta gave the assurance on Thursday (March 19) that all courts in the country are functioning and ready to tackle and resolve cases that may be brought before them in connection with the enhanced community quarantine as a measure against coronavirus disease (COVID-19). (SC PIO / FILE PHOTO / MANILA BULLETIN) Earlier, the Supreme Court (SC) had reduced the work hours in the country’s courts from 9 a.m. to 3 p.m. until April 15, and employees who are not part of the skeletal force are not required to report for work. The SC had also directed all justices and trial court judges to be on stand-by to act on urgent matters like those involving bail, petitions for habeas corpus, promulgation of judgment of acquittals, relief for those arrested, and resolution of legal issues related to the national health emergency All court hearings, filing of all pleadings required by the courts, promulgation of decisions in civil cases, execution of judgments, implementation of writs, service of summons, auction sales in extrajudicial foreclosures, and solemnizations of marriage are also suspended until April 15. But the SC said that court work and processes that can be done at home must be performed by court officials and employees. Meanwhile, Manila Metropolitan Trial Court (MeTC) Executive Judge Carissa Frondozo said that as of March 19 there has been no cases filed in court in relation to the curfew being implemented in the city. In her report to Court Administrator Jose Midas P. Marquez, Frondozo said that “so far, there has been no filing of any case pertaining to the curfew in Manila.” Earlier, Peralta said: “The Constitution and our laws are not suspended, and our courts are not shutting down in times of emergencies. “But with the situation still rapidly evolving and an atmosphere of uncertainty pervading, we must all do everything we can, including making drastic adjustments in our operations without sacrificing the need to attend to urgent cases that affect life and liberty, to prevent the spread of COVID-19, and protect the health and safety of our justices, judges, court workers, lawyers, and the public we serve.” READ MORE: Entire Luzon under quarantine
