DOJ junks illegal possession of firearms, explosives filed by PNP vs Negros Oriental Rep. Arnie Teves Jr.
The Department of Justice (DOJ) has dismissed the criminal charges filed by the Philippine National Police (PNP) against Negros Oriental 3rd District Rep. Arnolfo “Arnie” A. Teves Jr. for alleged illegal possession of firearms and explosives.
In a resolution issued last March 13, the DOJ ruled that the complaint against Teves “is not a proper subject for inquest since he was not arrested during the implementation of the search.”
“Considering that there is no enough evidence to proceed to a regular preliminary investigation with regard to him, the complaint against respondent Teves is dismissed,” the DOJ said in a resolution signed by Prosecution Attorney Victor G. Dalanao Jr. and approved by Senior Deputy State Prosecutor Richard Anthony D. Fadullon.
Aside from Teves, also charged by the PNP’s Criminal Investigation and Detection Group (CIDG) was Roland Aguisanda Pablio for violations of Republic Act No. 10591 on unlawful possession of firearms and RA 9516 for unlawful possession of explosives.
During the raid by agents of the PNP-CIDG in the houses reportedly owned by Teves in Barangay Poblacion, Basay town, reportedly seized were a .45 caliber pistol and magazine, two .40 caliber pistol and magazines; a rifle scope; one hand grenade and .45 and .40 caliber pistol bullets.
The narrations in the CIDG complaint and the legal reasons for the dismissal of the complaint could not be elaborated as only page one and page eight of the nine-page resolution were made available to journalists.
The dispositive portion of the resolution states:
“WHEREFORE, premises considered the undersigned respectfully recommends that upn the approval of this resolution:
1. “the attached information for violation of RA 10591 (unlawful possession of firearms) and RA 9516 (unlawful possession of explosives be FILED against ROLAND AGUISANDA PABLIO,
2. “the complaint against ARNOLFO ALIPIT TEVES JR. is DISMISSED.”
