DOLE backs legislation ensuring caregivers' safety

The Department of Labor and Employment (DOLE) has expressed support for the “Caregivers’ Welfare Act,” which implements legislation meant to safeguard domestic caregivers' welfare and rights.

On November 23, President Ferdinand Marcos Jr. signed Republic Act No. 11965, or An Act Establishing Rules for the Protection and Welfare of Caregivers in the Practice of Their Occupation.

“This landmark legislation reflects the government’s commitment to recognizing and addressing the needs of Filipino caregivers, who play an essential role in providing care and support to individuals and families,” said DOLE.

The DOLE pointed out that the law is consistent with the goals and tactics outlined in the Philippine Development Plan 2023–2028 and the Philippine Labor and Employment Plan 2023–2028, particularly in promoting and defending the fundamental rights and principles at work.

It actively engaged in the consultation and creation of the Caregivers' Welfare Act through the Bureau of Local Employment (BLE) and the Bureau of Working Conditions (BWC), giving vital feedback and expertise to ensure the law's comprehensive and effective coverage.

The bill applies to caregivers employed and working within the country in private homes, nursing or care institutions, and other residential facilities, including caregivers hired directly by employers or assigned through the Public Employment Services Office (PESO) and Private Employment Agency ( PEA ).

Under the law, caregivers also offer access to state-run enterprises such as the Social Security System (SSS), the Philippine Health Insurance Service (PhilHealth), the Home Development Mutual Fund (PAG-IBIG), and all other benefits in line with the relevant details provided by law.

Moreover, the Technical Education and Skills Development Authority was tasked with developing a system of ongoing skills to ensure that Filipino caregivers' professional service standards are globally competitive.

The DOLE, in coordination with the Department of Migrant Workers (DMW), TESDA, and other agencies, is also mandated to work together on the recruitment and deployment of Filipino caregivers for overseas employment to assure their protection, including reintegration.
