Pay workers properly on December holidays, DOLE tells private employers

The Department of Labor and Employment (DOLE) has reminded all private sector employers to observe the proper payment of wages for the upcoming December regular and special non-working holidays.

Under the Labor Advisory No. 26, series of 2023, Christmas Day (December 25) and Rizal Day (December 30) are classified as regular holidays, while December 31 is classified as a special non-working day pursuant to Proclamation No. 90.

If the employees did not work, they shall be paid 100 percent of their salary for the days indicated, while for work done during the regular holiday, the employees shall be paid 200 percent of their regular salary for the first eight hours.

For work done during the regular non-working holiday, the employees shall be paid an additional 30 percent of their basic wage on the first eight hours of work.

For work done over eight hours (overtime work), the employees shall be paid an additional 30 percent of their hourly rate on the said day.

If the employees work on a regular holiday that also falls on their rest day, they shall be paid an additional 30 percent of their basic wage on the first eight hours of work.

For overtime work on a regular holiday that also falls on their rest day, they shall be paid an additional 30 percent of their hourly rate on the said day.

Meanwhile, a “no work, no pay” policy will be implemented on December 31, unless there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day

For work done during the special non-working holiday, the employees shall be paid an additional 30 percent of their basic wage on the first eight hours of work.

For work done over eight hours (overtime work), the employees shall be paid an additional 30 percent of their hourly rate on the said day.

If the employees work on a special non-working holiday that also falls on their rest day, they shall be paid an additional 50 percent of their basic wage on the first eight hours of work.

For overtime work on a special non-working holiday that also falls on their rest day, they shall be paid an additional 30 percent of their hourly rate on the said day. (Trixee Rosel)
