Negros Oriental 2nd district Rep. Manuel Sagarbarria is prodding the Commission on Elections (Comelec) to reconsider its resolution for the conduct of the special election for the vacant House seat in the province's 3rd district.
Sagarbarria filed on Tuesday, Nov. 7 House Resolution (HR) No.1431, which stated that the conduct of special elections in Negros Oriental's 3rd district "at this time and under the present circumstances may have a negative impact on the peace and order situation not only in the district but also in the surrounding areas in the province".
The resolution was read and adopted by the House of Representatives during plenary session that same evening.
Comelec, via Resolution No.10945 and dated Aug. 30, 2023, had set the date for the special polls on Dec. 9, 2023.
The previous congressman of the province's 3rd district, Arnolfo Teves Jr., was expelled from the legislative chamber by his own colleagues last Aug. 16.
Sagarbarria noted in his measure that former Rep. Teves "continues to question his expulsion as a member of the House of Representatives by filing a petition for certiorari against the House of Representatives before the Supreme Court (SC)".
He also states in HR No.1431 that Comelec is handling pending disqualification cases against winning candidates in the recently concluded Barangay and Sanggunian Kabataan Elections (BSKE).
The BSKE was held last Oct. 30.
