Comelec to wait on House's go signal for Negros Oriental special polls

"This is entirely within their exclusive and original jurisdiction," Comelec Spokesman John Rex Laudiangco said in a text message, referring to the House of Representatives. 

It was in August when Comelec announced that a special election will be conducted on Dec. 9 for the vacant House seat in Negros. Comelec says that the special poll is meant to fill the vacancy in the House of Representatives (HOR) created by virtue of the expulsion of former Negros Oriental Rep. Arnolfo "Arnie" Teves.

This developed as Comelec Chairman George Erwin Garcia confirmed receipt of the Certification of Permanent Vacancy and the Resolution Calling for a Special Election from the House.

Negros Oriental's 3rd district has a total of 301,264 voters. 

Garcia said that P75 million has been allotted for the special election there.

However, the Comelec en banc decided last week to cancel the conduct of the special elections. It also decided to discontinue its ongoing preparations for the particular special elections.

"We are directing the regional election director, provincial election supervisor of Negros Oriental, including all election officers to inform all the parties, citizens arms, and stakeholders na hindi tuloy elections sa Dec. 9 sa Negros Oriental (that the elections on Dec. 9 in Negros Oriental will not push through)," Garcia said in a press conference.

He stated that Congress has both the power to call for a special election and to discontinue it. 

According to Garcia, Comelec will just implement the mandate of the House in this respect. 

"Miyembro nila ito (This is their member) so this involves a question of membership and should be resolved by the HOR," he added.

The poll chief also stated that the Comelec en banc accepted such a recommendation from the HOR being the body that can call and recall special elections for purposes of filling up the positions vacated by their members.
