Comelec can suspend proclamation of BSKE bets until election day--poll chief

In a press conference on Saturday, Oct. 28, Garcia they can still suspend the proclamation of candidates who will commit violations up to Monday.
"Pwede naming i-suspend ang kanilang proklamasyon kahit sa Monday. Tatandaan niyo sa gabi pa ang canvassing so sa gabi pa ang proklamasyon so pwede pa naming mahabol yung suspension ng proclamation (We can still suspend their proclamation even on Monday. Remember that canvassing and proclamation are at night so we can still suspend their proclamation)," he explained.
In relation to this, he said that guidelines have been issued to the Board of Canvassers (BOC) on how to accomplish a Certificate of Proclamation if a winning candidate is facing a suspension order since they have pending cases before the poll body.
Comelec recently released a list of 241 candidates who were subject to the orders of suspension of proclamation.
Garcia has explained that even if a candidate wins and a suspension order has not been issued against them, yet they have a pending case filed, they will still be under the jurisdiction of Comelec and the poll body can still remove them.
As for the 10-day campaign period that ended Saturday, the poll chief said that it has been generally orderly except for a few incidents of violence that happened in different areas.
"Kung may (It may be around) 95 percent, 98 percent generally nationwide naging maayos yung kampanya ng ating mga kababayan (the campaign period of our citizens has been orderly)," he said.
At the same time, he said that candidates also respected Comelec's guidelines when it comes to campaign materials. Garcia suggested to candidates that they remove their posters as it may be construed as campaigning.
Meanwhile, he warned candidates who will still be campaigning outside of the period designated by the poll body, that they will find out about it. He also said that children are prohibited from giving away campaign materials.
"Kalimutan na po natin at santabi na natin ang matandang gawin na ginagamit ang bata dahil hindi criminally-liable ang mga bata (Let's forget and set aside the old practice of using kids because they are not criminally-liable)," he said.
Those who will be campaigning outside the designated period of the poll body will be charged with illegal campaigning.
