Tolentino flags use of AI in election campaign, taps Comelec

Senator Francis “Tol” Tolentino on Saturday, Oct. 21, raised the issue of using artificial intelligence (AI)-aided election campaign and propaganda materials.

Tolentino raised this issue before the Commission on Elections (Comelec) and requested further study for future policy formulation, since apps that change the facial impressions of individuals may violate the principle of truthfulness.

He said that elections must be based on truthfulness, but through the use of AI, one can change one's looks. This prompted the Department of National Defense (DND) to prohibit its use.

The lawmaker looks forward to the Comelec formulating policy regarding the use of AI in producing campaign and software materials for the elections, especially on the question of what pictures can be allowed.

Comelec Commissioner Rey Bulay, in a statement, appreciated the issue Tolentino raised with regard to using AI in the production of campaign and software materials in the elections.

Bulay said the suggestion of formulating policies using AI in the production of election materials, whether printed or digital in form, can be done and maybe promulgated in time for the 2025 midterm elections.

“I don’t want to preempt my chairman and fellow commissioners, pero napakaganda po ng iyong sinabi (but what he said was very good). Pwede pong humabol yon sa 2025 (It can be timed in 2025.), the Comelec official said.

Commissioner Bulay said the possibility of using misrepresentation expanded to cover the candidate's personality could become criminal misrepresentation when violated and the basis for the cancellation of the Certificate of Candidacy (COC).

“The concept of misrepresentation is also included in the principle of truth in advertising…something along this line,” he added.

Commissioner Bulay said the Comelec is applying, at present, RA 9710, or the comprehensive women’s human rights law that seeks to eliminate discrimination through the recognition, protection, fulfillment, and promotion of the rights of Filipino women.

He said they have started enforcing the prohibition of posters that violate the sensitivities of people especially declaring illegal campaigning of materials that violate RA 9710.
