Sandigan junks plea of PNP's civilian employee to reduce bail in 4 remaining cases

The Sandiganbayan has denied the motion filed by Philippine National Police (PNP) non-uniformed personnel (NUP) Eulito T. Fuentes who pleaded a 50 percent reduction in the P690,000 bail in his four remaining graft charges.

In a 272-page resolution issued last June 21, the anti-graft court granted two of Fuentes' demurrer to evidence in his criminal charges and, consequently, he was acquitted of the two charges.

The same resolution, however, denied his motion to dismiss in the four other cases which will proceed to trial.

Fuentes, a civilian employee, is one of the co-accused in the cases filed against former PNP chief Avelino I. Razon Jr. in the alleged anomalous P409.7 million transactions on the repair and maintenance of V-150 Light Armored Vehicles in 2007.

The anti-graft court had also granted the demurrer to evidence filed by Razon in two of his criminal charges while his demurrer to evidence was denied in four criminal charges.

A demurrer to evidence is a pleading filed by an accused in a criminal case to dismiss the charge due to alleged weakness of the prosecution's evidence to sustain a conviction.

Razon and Fuentes were charged with violations of the Anti-Graft and Corrupt Practices Act in relation to Article 217 of the Revised Penal Code on malversation of public funds through falsification of public documents, and Section 65(b)(4) of the Government Procurement Reform Act.

In seeking a reduction of bail, Fuentes told the court that he has shown throughout the proceedings that he is not a flight risk because he has faithfully attended all hearings.

The Sandiganbayan junked his motion. It said: "The Court finds that accused Fuentes has not shown good cause for the reduction of his bail. The mere allegation that he is not a flight risk is insufficient to guarantee his attendance in the subsequent court proceedings for the presentation of defense evidence."

The court added that Fuentes' bail of P690,000 "remains reasonable."

The resolution was written by Fourth Division Chairperson Associate Justice Michael Frederick L. Musngi with the concurrence of Associate Justices Lorifel L. Pahimna and Maria Theresa V. Mendoza-Arcega.
