Comelec says party-list nominee not considered as candidate
A party-list nominee is not a candidate.

The Commission on Elections (Comelec) said this when asked if a partylist nominee, who is not able to sit in the House, can be appointed to a Cabinet post or to any position.
"Yes, as a nominee is not the candidate. The Party List group is the candidate," Comelec Acting Spokesperson John Rex Laudiangco said in a statement.
He added that the Constitutional proscription states that:"No candidate who has lost in any election shall, within one year after such election, be appointed to any office in the Government of any government-owned or controlled corporations or in any of its subsidiaries."
On Monday, May 30, it was announced that Erwin Tulfo, the fourth nominee of ACT-CIS in the May 9 polls, has been nominated as secretary of the Department of Social Welfare and Development (DSWD).
Meanwhile, the Comelec was also asked what will happen to the post to be vacated by Liloan City Mayor Christina Frasco who will be part of the Cabinet as Department of Tourism Secretary.
Comelec Commissioner George Garcia said the "vice mayor will become the mayor."
