Violators of ban on hiring and movement of personnel during election period warned

A number of complaints of violations of the ban on hiring and transferring of personnel in the civil service during the election period has been received by the Commission on Elections (Comelec) Law Department.

In a statement on Tuesday, April 26, the Comelec Law Department said one such complaint that it received pertains to the National Commission on Muslim Filipinos (NCMF).

"A complaint was filed before the Comelec against respondents newly-appointed NCMF Secretary Atty. Guiling A. Mamondiong, his Chief of Staff Atty. Manggay A. Guro Jr., and NCMF Executive Director Tahir S. Lidasan Jr. for issuing orders that are allegedly contrary to Sec. 261(g) of the Omnibus Election Code," it said.

"According to the complaint, Sec. Mamondiong allegedly created the positions of Assistant Bureau Director, Assistant Regional Director, and Assistant Service Directors," added the poll body.

The complaint, the Comelec said, also cited Mamondiong’s premature termination of contracts of Job Order employees at the same time he appointed job order employees.

"The NCMF secretary reportedly replaced incumbent heads of offices and appointed their replacements. These personnel movements were all effected by Mamondiong without the required exemptions from the Comelec, it was learned," it said.

The Comelec Law Department said it is currently investigating the complaint whether the NCMF violated the provisions of election law.

The Comelec then called on all concerned officials of government agencies and instrumentalities to stringently obey election laws and regulations.

The Comelec warned that election offenses carry the penalty imprisonment of not less than one year but not more than six years and shall not be subject to probation.

Appointment or transfer of personnel is prohibited under Comelec Resolution No. 10742, in accordance with Section 261 of the Omnibus Election Code.
