Court orders arrest of two motorcycle dealer execs

CEBU CITY -- A regional trial court has ordered the arrest of two executives of one of the biggest motorcycle dealers in the country for alleged falsification of documents and cybercrime.

Presiding Judge Nelson Galuna Leyco of Regional Trial Court Branch 27 in Lapu-Lapu City issued the arrest warrants against Marvin Ken Du and Cassandra Alexis Du, high-ranking officials of Des Marketing Inc.

The Dus are facing charges for two counts of alleged violation of Section 4, Paragraph B (for computer-related Forgery) of the Republic Act 10175 or the Cybercrime Prevention Act of 2012.

Bail for the cybercrime case was pegged at P120,000 per accused.

Another warrant has been issued against the two Dus for two counts of Falsification by Private Individual and Use of Falsified Documents in violation of Article 172 of the Revised Penal Code. Bail was set at P18,000 per accused.

Both warrants were issued on March 29, 2022.

The charges were filed by Land Transportation Office-Central Visayas (LTO 7) regional director Victor Caindec, who alleged that the company was involved in anomalous transactions.

In November 2021, the Lapu Lapu City Prosecutor's Office found probable cause to indict Marvin Ken Du, Carl Ryan Lim, Iwih Jane Du, and Cassandra Alexis Du for cybercrime and falsification of documents by a private individual.

Based on court records, Lim and Iwih Jane Du voluntarily surrendered on February 14, 2022, and posted bail.

While Cassandra Alexis Du was issued the said warrant and posted bail last April 4, 2022.

Marvin Ken Du has not posted bail and is still considered at large.

Marvin Ken Du is the Chairman of the Board of Des Marketing, Inc. and Du Ek Sam, Inc and a member of the Board of Directors of Desmark Corporation and Premio Corporation.

Carl Ryan Lim is the President and CEO of Des Marketing, Inc. and Du Ek Sam, Inc. while Iwih Jane Du and Cassandra Alexis Du are Corporate Secretary and Corporate Treasurer respectively of Des Marketing, Inc. and Du Ek Sam, Inc.

“All taken, the lengthy and exhaustive answer of the herein respondents but failed to address the lingering question behind the existence of two versions of the cash sales invoice receipts with glaring differences. One, issued to the customers and the other one, uploaded to the Land Transportation Office," read a November 2021 resolution penned by Assistant City Prosecutor Antonio Aseniero.
