Makati Prosecutor's Office junks cases against Dacera's companions, mom
The Makati Prosecutor's Office on Monday, Feb. 7, dismissed the consolidated complaints against those allegedly involved in the death of flight attendant Christine Dacera, who was found lifeless in a bathtub at City Garden Grand Hotel in Barangay Poblacion, Makati on Jan. 1 last year.
In a decision dated Jan. 31, the Prosecutor's Office dismissed the legal complaint for Administering of Illegal Drugs filed against one of Dacera's companions during the incident, Mark Anthony Rosales.
The dismissal stemmed from the prosecutors statement that "there was no proof of evidence that could establish the alleged administration of any illegal drug into the body" of Dacera.
Eight other individuals, namely Rommel Galido, John Pascual Dela Serna, Gregorio Angelo Rafael De Guzman, Jezreel Rapinan, Alain Chen, Reymar Englis, Darwin Joseph Macalla and Atty. Neptali Maroto, were absolved from the case of Obstruction of Justice.
Medico-legal officer Maj. Michael Nick Sarmiento was also absolved from his case of falsification by the prosecutors due to the failure of establishing that the fact narrated by him were absolutely false.
Louis De Lima, together with Galido, Dela Serna, Rapinan, and Chen were also absolved of their perjury charges.
Meanwhile, the prosecutor's office also cleared Dacera's mom, Sharon, from charges filed against her such as libel, slander, and cyberlibel due to "lack of proof of malice."
The complaints for illegal detention, arbitrary detention, and unlawful arrest filed by Dacera's companions against Sharon, Sharon's friend and doctor Marichi Ramos, Dacera's cousin Katherine Anne Facelo, and two other police officers were also dismissed.
The decision was reached due to "no evidence that they effectively controlled and directed the respondent-police officers to arrest and detain the complainants."
The histopathology conducted by the medico-legal revealed that Dacera died due to ruptured aortic aneurysm, meaning the manner of her death is natural. It is consistent with the findings in the autopsy report of the police.
In the report, it was determined that Dacera’s underlying cause of death is ruptured aortic aneurysm.
